THE EMMIGRATION FROM FRANCE TO AMERICA
Nicholas had one known sibling; a brother named John Hayne. They came t o America together from France in between 1830 and 1840. Nothing is kno wn about the location in France from which they emigrated.
NICHOLAS' DEPARTURE TO ALABAMA
Not long after they arrived in New York, Nicholas Hayne decided to trav el south through the Carolina's to Georgia and then to Alabama. The fir st recorded Census for Nicholas being in Alabama was in 1860, so this m eans he was probably in Alabama between 1850 and 1860. There is apparen tly a time period twenty plus years between 1830 and 1840 and 1850 and 1 860 for which there is no account. Some of those years were spent in Ge orgia between 1846 and 1856, as attested by the births of six children. T his accounts for at least ten of those years. The remaining ten or more y ears could been in other states including South Carolina, where his wif e Milinda was born.
JOHN HAYNE'S FORTUNE IN NEW YORK
John Hayne decided to stay in New York and became wealthy buying up rea l estate. At one time, he owned an entire block in what is now Brooklyn , New York. He never married or had children. When he died in 1876 in N ew York, he supposedly left everything to his nephew, John Nicholas Hay ne, a son of his brother, Nicholas Hayne. John Nicholas was named after h is father Nicholas and his father's brother John. At some point in the l ate 1800's and early 1900's, there was an attempt made to claim the inh eritance but the family. At this time, it is unclear as to why there wa s problem with claiming this inheritance, but it has thought that it wa s unwillingness to put up the money that was required by an attorney in o rder to investigate the claim.
A second attempt was made in 1924, according to letters written between l awyers in Birmingham and New York. Quoting from a letter from Horace C. W ilkinson Esq., Counselor at Law in Birmingham, Alabama to Hon. Richard H . Clark in New York City "I represent some heirs here who claim to have a r ich ancestor who died in New York City. Their story is that John Hayne d ied in New York City in 1876.
have been worth about a half million dollars, there is some kind of tra dition they have dug up, to the effect that he left a will, leaving his e state to John N. (Nicholas) Hayne, who died in 1915 or 1916, leaving su rviving seven children.
Some of the children tell me that sometime ago a Birmingham lawyer went t o New York and investigated the records and found an account of the dea th of the old man and a will or something of that kind, and seemed to h ave the opinion that there was a legacy there, but wanted the people he re to put up some money, which they were unwilling to do. Since that ti me, the heirs who refused to put up the money have died, and of course a n ew bunch of heirs are in control."
There is more to this letter, but in the end, the family received nothi ng from the supposed inheritance, either because the second set of heir s would not put up the $250 required by the New York lawyer, or he coul d not find anything. The state of New York eventually claimed his prope rty when the statue of limitations ran out for non-payment of taxes.
The family moved to Alabama between 1856-1859. This is because Matthew w as b. 1856 GA and Mary was b. 1859 AL.
Nicholas is not listed on the 1870 Census. It is presumed that he had d ied between 1860-1870. He might have been in the Civil War and died in c onflict. (No Civil War document has been requested.)
