3. JOHN3 FRANCIS, SR. (HENRY2, MISTER1)10,11 was born Abt. 1753 in Virginia12, and died October 09, 1829 in Near Monticello, Wayne County, KY12. He married NANCY ANN MOUNTS12 May 15, 1784 in Lincoln County, Kentucky13,14. She was born November 26, 1761 in Maryland15,16, and died June 02, 1855 in Macedonia, Livingston, Missouri17.

      "John was a lieutenant in the Montgomery County, VA, militia. He was in the battles of Camden, Guilford Court House, and Kings Mountain during the American Revolution. About 1783, he moved to KY. After his marriage, he moved to Wayne County, KY, where he served as high sheriff from 1801 until 1813."

      "The first documented notation of John Francis was when it was ordered that he be appointed Constable in Capt. Francis' Company, Montgomery County, VA. (Annals of Southwest VA) He is also shown on the tax list for that county in 1782. John was appointed "heir at law" after his father's death in 1780. At that time, he was still living in VA. In 1784, he gave a power of attorney to James Newall, Jr., in his father's estate matters. At that time, John's place of residence was given as Lincoln County, KY.
      "John's pension application, which included pages from the Bible Record, had a notation that he killed the Tory that shot his father, Henry Francis, at the Battle of Shallowford, North Carolina.
      "The first documented date of John being in KY was his marriage to Nancy Ann Mounts, in 1784. He was listed in the 1789 Tax List of Madison County, KY, and in the 1799-1800 census of KY, compiled from tax lists, listed as living in Cumberland County, KY. On Dec. 24, 1798, John was granted 200 acres of land in Green County, on Beaver Creek. His brothers Samuel and Henry were also granted 200 acres each, Samuel on Elk Spring Creek in Green County, and Henry on Fishing Creek, in Lincoln County.
      (note: Counties were changing boundaries so often, with new counties being established from the splitting of larger counties that some settlers have been listed in 2 or more different counties without ever having moved. In this instance, part of Green County became Wayne County.)
      "John Francis, Gentleman, was sworn in as First High Sheriff of Wayne County, KY, by Judge Cullom on April 20, 1801. He held this office until 1813. In those days, a High Sheriff often acted as a judge. Since there is a mention that John also served as a judge for a number of years in Wayne County, it isn't known if that was a separate appointment, or in concurrence with the office of High Sheriff.
      "At a Dec. 10, 1810 court session, John was authorized to locate 1,000 acres of land in Wayne County, to include 'salt lands.' During the summer of 1817, John Francis and Richard Slavey began trials for salt diggings (wells). Each claimed to own entry of 1,000 acres on Bear Creek.
      "One day while working the salt diggings, they hit a pocket of oil, which sprayed oil all over the salt wells. John thought the investment was ruined, and he sold his share fast. This was thought to be the first oil well in the country. However, they didn't know what to do with oil at that time." (end of Charley's notes)

ANCY ANN MOUNTS:
      According to the research of Neil Fetter, after John died, Nancy went to Georgia where she lived for 12 years. She returned to Wayne County, Kentucky about 1845. In 1849 she moved to Missouri and lived with her son Elisha in Macedonia until she died.

      It's not clear who Nancy's parents were, or if Mounts is her birth surname or a married name. A notation in the Lincoln County, Kentucky Order Book #1, showed, "On the motion of Nancy Mounts, administration is granted her on the estate of Absalom Mounts, dec'd." Absalam's age isn't mentioned, or any other family members, nor is it noted what relation he was to Nancy. It said that Absalom was killed by Indians while he and a friend were trapping on Station Camp Waters, Kentucky.
