She appeared in court in Dec 1780 in Rutland, Rutland, VT. (4699)(9102) (9103) Lydia's story get more interesting after she marries the Colonel. "Mrs. Lydia Herrick, wife of Col....... Samuel Herrick, both of Bennington" was charged with Adultery in Rutland Superior Court in December 1780. She was accused of infidelity with with Isaac TICHENOR (354). TICHENOR would later become Governor of Vermont and a US Senator. There was a grand jury investigation but neither was indicted and there is no further record.

Isaac TICHENOR was born in Newark, NJ. He graduated with a degree in law from Princeton in 1775. He came to Bennington in 1777 as a Continental quartermaster officer. He was court-martialed shortly thereafter for misappropriating public funds and failing to supply needed materials, however, according to Vermont Rolls of Revolutionary Soldiers, the charges were postponed to a later date. Despite the court martial and adultery charge, TICHENOR was elected to the Vermont General Assembly in 1781, served as Governor of Vermont from 1797 to 1807, and as US Senator from 1814 to 1821 (594).

Isaac TICHENOR had earned the nickname "Jersey Slick." Some historians like Crocket claim that it was a term of endearment dubbed by his friends due to good manners, dress, and character (595) but most seem to claim that TICHENOR was nicknamed "Jersey Slick" by his political enemies. He was able to squelch both an adultery charge and a court martial. Most short biographies on TICHENOR cite his roots in Princeton and rise to Governor and Senator but fail to mention his court-martial or adultery charges altogether. She moved in Sep 1787 to Springfield, Otsego, NY.(4684) (9104) I have several land sales records for the Colonel (362). This is the first that records Samuel Herrick as a resident of Springfield. The History of Springfield (363) records that he resided there with his second wife. She was a tavern owner on 1 Mar 1798 in Springfield, Otsego, NY.(9105) Lydia may have shared the work with Samuel. She signed a will on 6 May 1812 in Springfield, Otsego, NY.(4700) (9106) She died in Jun 1812 in Cooperstown, Otsego, NY. (9107) Died of consumption. Parents: Samuel TUBBS and Hannah WOOD.

She married to Colonel Samuel HERRICK between 1777 and 1780. (4699)(4700) (4686) Samuel HERRICK and Lydia TUBBS probably married in either New London, CT or Bennington, VT.

The 1846 and 1885 Herrick books and probably two dozen DAR applications claim that the mother of Colonel HERRICK's youngest children, Daniel (b 1762), Francis (b 1764), and David (b 1766), was an unnamed 2nd wife. This is very unlikely. By 1780, Colonel Herrick had married Lydia TUBBS. Lydia was the daughter of Samuel HERRICK's Bennington neighbor and longtime friend Samuel TUBBS, whom he had known back in Norwich. Lydia TUBBS was literally the girl next door (according to a 1785 Bennington plat (351). She was also the sister of Miriam TUBBS, who married Samuel HERRICK's son Francis. Lydia's will names her siblings (they match the children of Samuel TUBBS) but calls the children of Samuel HERRICK her nieces and nephews (365). This was probably because Lydia was 29 years younger than Sam and essentially the same age as his children, so she may have been reluctant to call them her "children."

I do not know exactly when Samuel and Lydia married, but it occurred before Dec 1780 (354) but after 1777, assuming Lydia was at least 16 when they married. In any case, Lydia TUBBS was practically a child bride and far too young to be the mother of Sam's children born in the 1760s. Silence KINSLEY was probably the mother of all of Samuel's children unless Samuel HERRICK had yet another wife between Silence and Lydia, but this seems far less credible.

(2757)(4579) The 1846 and 1885 Herrick genealogies state that Francis died in Pamelia, Jefferson, NY, but he is living in Springfield in 1790 (age 26) where his father Colonel Samuel had removed, 1810 (age 46), 1810 (age 56), and 1820 (age 56). In 1830, her is not listed as living in either Oswego or Jefferson counties (although he could be living with one of his sons and show up only as a male over 45). My Jefferson county burial records do not list Francis but do list his second wife so maybe he is buried in Pamelia (342). Francis may not have lived long after 1830. His brother Cyprian died in 1806, 48 years old. (9134) The genealogist Hellen Judson completely contradicts herself regarding whether William was indentured. First she say that "We know that he was a servant (indentured prob. for passage money)" and even uses an assumed period of indenture to estimate an emigration date. Then later she says "he was not a man that needed to work and pay for money borrowed generally to pay for passage." He was an one of 30 men chosen by Miles Standish to explore the area around Plymouth. in 1634. (9135) It is assumed that this took place in 1634. He appeared in court on 7 May 1635 in Plymouth, Plymouth Colony. (9136) William sued John Barnes for lack of payment. William had been contracted to deliver 12 bushels of corn to barnes, but delivered only 10. barnes refused to pay anything. The court ordered Barnes to pay for 10 bushels of corn, plus all court costs, less the damages he incurred by way of profit loss due to two missing bushels. He took the oath of a freeman on 7 Mar 1636/37 in Plymouth, Plymouth Colony.(9137) He moved before 1637/38 to Duxbury, Plymouth, MA.(9138) He took the oath of a freeman on 2 Jan 1637/38 in Duxbury, Plymouth Colony. (9142) He William sold his home on this date, which was uncommon and may have been a precursor to his divorce in Nov 1653 in Duxbury, Plymouth Colony.(9143) He was one of several servant and freemen granted land on 3 Jun 1662 in Plymouth Colony. (9144) He was a cordwainer (leather tanner and shoemaker) in 1664. (9145) He Samuel NASH and John SPRAGUE were fined £3 for witnessing a document for seprating William and Mercy in 1664 in Plymouth Colony.(9146) The document was written by William Pabodie. He appeared in court in Jun 1664 in Plymouth, Plymouth Colony.(9147) By this time, William's wife Mercy TUBBS had been found guilty of repeated acts of adultery and had moved to Rhode Island. At this court, William TUBBS disowned himself of any further debt from Mercy. Divorce was eventually unheard of in Puritan New England in the mid 1600s. There may not have even been a precedent for it. William TUBBS, however, in a case called "unusual" in the book "Liberty and Disunion, 3 Centuries of Divorce in America, claimed a biblical justification. He cited his authority to claim divorce in Deuteronomy 24:
"When a man hath taken a wife, and married her, and it come to pass that she find no favour in his eyes, because he hath found some uncleanness in her: then let him write her a bill of divorcement, and give it in her hand, and send her out of his house. And when she is departed out of his house, she may go and be another man's wife."
TUBBS prepared the bill himself and it was signed by witnesses. A divorce was granted by William Peabody, but the court not only overruled it, but fined Peabody 5 £ "for makeing a writing regarding William Tubbs marriage vows." Thus the court refused to grant William TUBBS a divorce despite having previously acknowledged, fined, admonished, and issued restraining orders against Joseph and Mercy. For the next four years, during which time William and Mercy were estranged, William petitioned the court for a divorce periodically, and may have added additional evidence to his case, before the court finally granted the divorce. He appeared in court on 3 Jun 1668 in Plymouth Colony. (9148) On this day, the court decided to grant William TUBBS a divorce which became effective on 7 Jul 1668. He signed a will on 20 Feb 1677 in Duxbury, Plymouth, MA.(9149) William gave most everything to "his loving wife Dorothy" to use until her death, when he requests that it be returned to his heirs. This was in keeping with their prenuptial agreement. William signed his will with his mark. He was a surveyor of highways in 1678 in Duxbury, Plymouth, MA. (9150) He may have also been a surveyor in 1885, but this may have been his son William. He died on 2 May 1688 in Duxbury, Plymouth, MA. (9151) He was educated He signed his will with his mark.(9152)

He married to Mercy SPRAGUE on 9 Nov 1637 in Duxbury, Plymouth Colony.(9153) (9154)(9155) (9156) Judson states that he was "probably" married in Duxbury. He was divorced from Mercy SPRAGUE on 7 Jul 1668 in Duxbury, Plymouth Colony. (9157)(9158) On this date, William TUBBS was granted a divouse from his wife after trying to do so for 17 years after Mercy was first admonished for unpuritanlike behavior, and 4 years of repeated petitioned for divorce from William TUBBS, during which time he and his wife were estranged, the court decided to give Mercy just one more chance. it sent a notice to Mercy , now living in Rhode Island, "to return to William or lose all rights and claims against him." When her negative reply was received on 7 Jul 1668, the court granted William his divorce that day:
"Whereas a Marcye, the wife of William Tubbs, being a woman of ill fame and light behavior ... hath for ... four years ... [dwelt in] another colonie ... and ... will not be reclaimed nor pswaded to returne and abide with him as shee ought to doe ... and ... liue with him as shee ought to doe .. that he should be divorced from her ... and she hath since, before competent witness, professed and affeirmed that shee will never return againe unto him while her eyes are open ... This court, therefore, sees cause and doe hereby declare, that the said William TUBBS is legally cleare from his covenant of marriage formerly made with Marcye, his late wife ... and Marcye hath cutt of herself any right henceforth to the pson or estate of the said William TUBBS, her late husband, and hereby allowing him liberte to dispose of himself in marriage, if hee see fitt soe to doe." William and Mercy probably had other children, but no records have been found thus far. Savage says that William was one of the first proprietors of Bridgewater, but it seems likely that William ever lived in Connecticut. Children were: Samuel TUBBS, Bethya TUBBS, William TUBBS.

He married to Dorothy in 1672 in Duxbury, Plymouth, MA. (9159) Judson mistakingly states that the couple were married on 23 Mar 1672 when that is the day she later says that they signed a prenuptial agreement. Children were: Benjamin TUBBS, Joseph TUBBS.
