1847 - Davie Co.,NC Daniel James Ratledge died intestate.
1847-1856 Davie and Iredell Co. NC Court records - Because Daniel died
intestate (without a will) the widow Elizebeth Ratledge had to file a
petition in the Davie Co. court to sue the other heirs of Daniel for
her dower rights to gain her 1/3 dower portion of the estate. This
does not mean there were hard feelings, just that it was the way the
law worked to protect the widow. Otherwise the land would have been
divided equally among all the heirs.
Their son Gillium, who owned his own farm, had lived on the estate
caring for the aging parents and the farm. His siblings then sued him,
saying he took from the father's estate and mismanaged it. He had to
go to court to defend himself. His affidavits from friends proving his
ability and honesty are on file in the court records. He later sold
his own property and moved to Kansas. Parents: James Sr. Ratledge and Ruth Unknown.

He was married to E. B. Jacobs in 1787 in Rowan County, North Carolina. Children were: T. Ratledge, Margaret Elizabeth Ratledge, Leoisi Ratledge .

He was married to Elizabeth Taylor about 1801 in Rowan County, North Carolina. Children were: Thomas Henry Ratledge, Adeline Martha Ratledge, James S. Ratledge, John F. Ratledge, Gillium R. Ratledge, Rebecca Ratledge.

bullet Daniel L. Ratledge was born about 1805 in Rowan County, North Carolina. He died in 1877 in Douglas County, Missouri. BIOGRAPHY
Information on Daniel L. Ratledge from DeKalb and Wilson Co.'s,TN, Douglas Co., MO records, and from family information related by family members. An Allen Lynn signed the marriage bond of his father, James Ratledge jr. and Lynn may be his middle name, or possibly it stands for Lindsey, another neighbor.

Tennessee census records indicate Daniel probably left his family in Greene Co., TN shortly after the 1830 census. Several of the Rowan/Iredell Co., NC families moved about this time to Wilson Co., TN and formed the town of Statesville, named after the town in Iredell Co. NC and I believe Daniel migrated with this group.

"History of Dekalb Co., TN" . . an excerpt taken from the ledger of a Dr. Overall of Alexandria, covering a period from1830 to Oct 1834, one of the names mentioned is Daniel Ratlidge. The town of Alexandria is located on the border of DeKalb Co. and Wilson Co. and is not far from Statesville in Wilson Co. It's possible that there were other children born to Daniel and Malinda during this time who died and the reason for the Dr's record.

Daniel and Malinda appear on the 1840 DeKalb Co. census - one transcription says Dist. #2 and another says Dist. #3 - both these districts on the county line between DeKalb and Wilson Co.

Daniel and Malinda moved to Missouri before 1855, probably with her father and brother's family who had been living in Kentucky. Malinda's "Church Letter" from the Christian Church of Alexandria was mailed to Fredricktown, MO (Madison Co). It was dated 1855. There is no record of Daniel Ratledge in Madison Co., MO, but he does appear as follows:

1860 Taney Co., MO census- Campbell Twp.
#476 RATLEY, Daniel 56 b. NC (1804/1805)
Melinda 51 b. SC (1809/1810)
James 20 b. TN (1840/1841)
Sarah 9 b. TN (1851)

In 1864 Cambell Twp. Taney Co. became Buchanan Twp. Douglas Co., Missouri. This included the land near the community of Roy where Daniel Ratledge lived and homesteaded in 1871. Daniel L. Ratledge filed Application #4930 for 80 acres described as being the W1/2 SW 1/4 Sec 4 Twp 25N Range 17W on 22 Feb 1871 on which he was living. This land lies next to county road #432 and adj. to the Johnson Cemetery. Daniel died in 1877 and his widow made the final payment of $2 in 1877 and so the document was filed in her name.

On Mar 10, 1887 Malinda conveyed 35 acres of this land described as being the NW4, SW4, Sec. 4, Twp 25, Rng 17 to Benjamin D. Payne her grandson in law who was m. to Eliza J. Ratledge.

Malinda 59 b. SC (1810-11)
Sarah 18 b. TN (1852-52)
Eliza J. 5 b. MO (1865)

Family history relates Daniel died while plowing his field. His family became worried when he didn't return for the evening meal and found him where he fell beside his plow and with the horse still standing there.

Malinda Ratledge appears as a widow on the 1880 Douglas Co. census with granddaughter, Eliza, age 15 living with her. It is very likely that both she and Daniel are buried in the Johnson Cemetary which lies next to the boundaries of land where the Ratledge and Adams families lived. Their son, James S. Ratledge is buried here as well as William Adams and two of his children and members of the John Johnson family.

Living across the road on the 1880 census, was Malinda Ratledge's married daughter, Sarah Jane Adams. Sarah Jane related to the family that she had lost all her brothers and sisters to the Cholera and that she had to help raise her brother's child. Since she was the youngest, most of Malinda and Daniel's other children who might have died were gone before she was born. The child Eliza J. who is on the 1870 and 1880 census living with Malinda is believed to be a daughter of James S. by a first wife - name unknown. The Hartley family records indicate that this belief is also the history in their family.

It is not known exactly when Malinda Ratledge died. She was alive in 1887 for the land transaction to Ben. D. Payne, but is not on the 1900 census. There is no 1890 census. There is a photo of her available taken in the 1880's. Parents: James Jr. Ratledge and Edy Johnston.

He was married to Malinda N. Johnson on Aug 27 1831 in Wilson County, Tennessee. Children were: James Shaw Ratledge, Elijah Ratledge, Sarah Jane Ratledge.
