Jacob Booe Jr.'s will is located in Will Book 1 page 103 in Davie County, North Carolina.

Notes from Jacob Booe Jr.'s will: (taken by Sarah Perce) To the children of my daughter Fanny, land that was to be equally divided, "to my son William Booe, I will the tract of land that was given to me by my fathe Jacob Booe...not to sell any of the timber...at his death to grandson Jacob Booe.... I give to my son William Booe the Mill deeded from George Booe. The will of Jacob Booe Jr. gave land to his daughter Sarah Holmen, but to Naomi he put money in a trust with the interest to be paid to her during her natural life and then to be divided amoung her children.

The will was dated 1812 but was not recorded until 1855. The sole executor was his only son William. A note included with the will said that a notch and a hole had been made in the writing with a sharp instrument and the names of the testator and witness removed. The will was probated two years after filing by the grandson - William B. March.

Naomi Foster contended that the mutilation of the will made it invalid. She entered 14 legations into the Davie County Courts. She also sought satisfaction in the Rowan Courts.

In Heidelburg Cemetery a Fanny Booe is buried the stone states: FANNIE BOOE WAS BORN MAY 23, 1779 AND DEPARTED THIS LIFE NOVEMBER 21, 1800. I have been informed that this is NOT the orginial stone for her grave. This is a reprint and that the dates on the stone are different from the first stone. In a letter dated May 17, 1985, in the Davie County History files to a out of town researcher the reference librarian states that In Heidelburg Cemetery a Fannie Booe is buried the stone states:
1. FANNIE BOOE WAS BORN MAY 23, 1779 DIED NOVEMBER 21, 1800
also in this cemetery
2. Booe_______ single and grave also contains two daughters who died of smallpox, no names recorded.
