The Will of Abel Waters:

In the name of god, Amen, I Abel Waters of Longueil in the County of Prescott, in the Ottawa District of the province of Upper Canada, Being of sound and Disposing mind and memory - Do make and ordain this my last will and Testament: That is today - I will that my just debts and Funeral charges be firstly paid and Discharged by my Executors herein after named, I give and bequeath to my son Daniel Waters, and his heirs one Lot of land, containing two Hundred Acres - more or less - being composed of Lot number fifteen in the second Range of Lots - in the Township of Polton in the District of Montreal; in the province of Lower Canada, for which I have an order in Council, I give and bequeath all my Lands and Tenements in the province of Upper Canada, that I do not dispose of before my decease, to my two other sons Truman Waters and Charles Waters - to my grandson Abel Waters the only son of the said Charles Waters. To my three daughters Lucy Botford, Eunice --Hartwick and Sally Ann Brown and their Heirs and to the Heirs of my Deceased daughter Betty Ann Day - after the same shall have been justly appraised at its just value in money - to be divided in shares among them in the following manner. What is to say - I give and bequeath to my said son Truman Waters the one sixth part thereof - I give and bequeath to my said son Charles Waters the one twelfth part thereof - I give and bequeath to my said grandson Abel Waters the one twelfth part thereof Which I will, shall, case my said grandson Abel Waters happens to die in his minority or afterwards, but without Lawful Heirs - and not having disposed of the same revert and belong unto my said son Charles Waters and I give and bequeath to my said Daughter Lucy Botford and her Heirs the one sixth part thereof - I give and bequeath to my said Daughter Eunice and her Heirs the one sixth part thereof - I give and bequeath to my said Daughter Sally Ann Brown and her Heirs the son sixth part thereof - I give and bequeath to the Heirs of my said Deceased Daughter, Betty Ann Day the one sixth part thereof - I also give and bequeath to my said son Charles Waters - all the Real Estate (lands and Tenements) that I possess - own or have any right or title or claim to Else Where and particularly - two Lots or piece or parcels of land situate lying and being in the Town of Falmouth in the County of Cumberland in the State of Massachusetts (formerly Colony of Massachusetts Bay in New England). The Deeds of the same bearing date the sixteenth day of June Anno Domini, one thousand seven Hundred and Seventy-seven and are to belong to my said son Charles. I do also give and bequeath to my said son Charles my silver Watch and gold Watch chain - and all my wearing apparel and all the remaining part of my farming utensils that I do not dispose of before my decease. I give and bequeath to my said Grandson Abel Waters, my surveyors compass - Chain - Staff & Socket - together with my case of Surveyors Instruments - and Survey Book of Trigonometry - I will and give all my Household Furniture to my two Daughters, Eunice and Sally Ann - to be Equally divided between them Share and Share alike each to have as much as the other - I will and bequeath to my two granddaughters Margery Brown and Sarah Ann Brown ten dollars each to be paid out of my live stock, and money that remain after my decease - I will and bequeath to my two Daughters Eunice, and Sally Ann and to my said son Charles Waters and their Heirs all my live Stock and Money that be found remaining after paying and discharging all incidental charges and Expenses Funeral charges - and paying my just debts - to be equally divided among them share and share alike - the one to have as much as the other that is to say the one half thereof to be thus divided between my said two Daughters Eunice and Sally Ann and their Heirs, and the remaining other half thereof to my said son Charles Waters and his Heirs. And it is my Express desire, that my corpse be interred in a private manner without parade or funeral Ovation----------------------------------------------------------------Lastly - I do hereby Ordain and Appoint my said son Charles Waters, my son in law Elijah Brown and Joseph Charles of Hantagert in the Ottawa District aforesaid Esquire, Executors of this my Last Will and Testament hereby Revoking all my former wills and Testaments by me made. In Witness where I have hereunto set my hand and seal the Twenty third day of February in the year of our Lord on Thousand Eight hundred and Twenty five-
