40. * Benjamin RAINEY [RANEY] (33) died between 1847 and 1850 in Florida, Monroe, MO. He was born in Kentucky. He was a Farmer. Benjamin Rainey received a license to marry Margrett Scott. The follow document was filed in Garrard County, Kentucky.
October the 21, 1828 Isabel Scott has agreeable consent that Benjamin Rainey might receive license for to marry her daughter for on under this day. (The name of Margaret Scott's mother leads us to believe she was a widow at the time, else the father would have signed it.) Known all men by these presents, THAT we Benjamin Rainey and Jacob Ogloby are held and firmly bound unto the Commonwealth of Kentucky in the penal sum of 50 lb., current money, the payment of which well and truly to be made, we bind ourselves, our heirs, jointly, severally and firmly by these present Sealed and dated this 21st day of October 1828 The condition of the above obligation is such, that whereas there is a LICENSE about to issue for a MARRIAGE shortly intended to be had and solemnized between the above bound Benjamin Rainey and Margaret Scott. Now, should there be no just cause to obstruct the said MARRIAGE, then this obligation to be void, else to remain in full force and virtue.

The following hand written (making reading hard to make out some words). This document indicates that this may have been the time Benjamin and Margaret Rainey move to Missouri. Know all men by these presents that I Benjamin Rainey of Garrard County and State of Kentucky hath this day bargained and sold unto Charles Syeacky of the County and State of the aforesaid one blind bay mare and colt and one white cow and yearling and the balance of my crop after haying the vent out of the crop and I the said Benjamin Rainey hath bargained and sold and confirmed unto the said Charles Syeacky the alone mentioned property from me my heirs on assigns for the sum of thirty dollars the reception here of said Rainey acknowledges. But when the said Rainey pay up above mentioned thirty dollars to the said Syeacky the above mentioned property is to be the property of the said Rainey but until the above thirty dollars is paid the property is to be considered to belong to the said Syeacky in confirmation I have this day affixed my hand and seal given under my hand this second day of August in the year of our lord eighteen hundred and thirty one.

It became obvious that in the three years since his marriage, the he had accumulated very little. This was not unexpected due to the poor wealth of the area. It is believed that Benjamin died some time between the years 1840-1850, leaving Margaret with a large family, a small estate and no means to support them. Because Margaret was illiterate, this could be the cause for the change in the spelling of the last name. After the death of Benjamin, it is apparent that Margaret lived with the oldest son, William, and that they continued to farm in Monroe County. He was married to * Margarett SCOTT on 21 Oct 1828 in Kentucky. (127) Benjamin Rainey received a license to marry Margrett Scott. The follow document was filed in Garrard County, Kentucky.

41. * Margarett SCOTT was born in 1810 in Kentucky. She Of Lexington, Fayette, Kentucky. (128) It is believed that Margaret is related to Gen. Winfield Scott, of the War of 1812 and the French and Indian War, & the Civil War.
Margaret Scott b.1810 Dinwiddie Co., Va married Benjamin was 2nd cousin once removed to Gen. Winfield Scott. People may have called him "Uncle" because he was older and as a sign of respect.
After Benjamin died Margaret and her six younger children lived with the oldest son, William.
Family Story: With the Union troops foraging for food and animals, came to Williams farm. Margaret saved their most valuable material, wool, by placing it in the churn on which she sat holding an ax in her hands daring any soldiers to come close. Children were:

child v. James RANEY was born in 1839.
child vi. Samuel Harvey RANEY was born in 1840. He joined the Confederate Army at Berryville, Arkansas.
