FIRST GENERATION

1. William LIVELY(1) was born in 1770 in Virginia. He died before 20 Feb 1809 in Clinch River Granger, Tn.. Family tradition reports that William Lively resided "near the Horseshoe Bend of the Clinch River" in Tennessee and that he came from Augusta Co., Va. The latter is further corroborated by the statement in his son Berry's bounty land warrant file that Berry was born in Augusta Cp., Va. Noted in the records of Augusta Co., Va., is the marriage bond for William Lively and Ann Ross date 26 Oct 1790. Similarity of family names suggests that William Lively of Grainger Co., TN., may have been a brother of David Lively of Spotsylvania Co., Va.

When John Lively, son of William Lively and Nancy, died in East Baton Rouge Parish, La., the settlement of his estate revealed some additional evidence of this family unit (East Baton Rouge Parish Probate Records, #63-4). On 22 May 1826 an inventory of the estate of John Lively, deceased, was held at Berry Lively's house. The estate included an improvement (house) occupied by Berry Lively and a debt owed by Galan Lively for a horse and cash. Galan Lively of east Baton Rouge Parish, La., was appointed curator for the absent heirs of John Lively, deceased, on 28 July 1826 (also given as 21 Mar 1826).

In his petition to be appointed curator, Gaylan stated that John died Oct 1825 leaving "considerable property, the legal heir to which is his mother Nancy Lively now residing in the state of Tennessee and that there is no one to represent said absent heir." In 1827 Berry Lively counter-petitioned saying that John's estate owned him $869 for caring for John who had been sick from 1 Sep 1818 to Jan 1824, that personal property belonging to Berry had been inventoried in John's estate, and that he (Berry) had sold various items of property to John for which payment had never been received. The final outcome of the suit remains hidden in the illegibility of the remaining courts records pertaining to the case.

William LIVELY and Nancy MCMORTON (?) had the following children:

child3 ii. John LIVELY(1) was born in 1794 in Virginia. He died in Oct 1825 in East Baton Rouge Parish, La. John died from wounds he received in the Battle of New Orleans (War of 1812). John enlisted 25 Sep 1813 and served 5 years on Capt. Ferdinand L. Amelung's Co. H, 1st Regt., U.S. Infantry. He was a farmer at time of enlistment, was a sergeant at time of discharge, and received 160 acres of bounty land based on this service (Bounty Land File, #12-160-WT22019).
child4 iii. William LIVELY(1) was born about 1796. Reportedly moved to Florida.

child7 vi. Garland LIVELY(1) was born about 1806. Probably the Garlan Lively listed in the 1830 Census Of Hines Co., Miss., with the following family: Males --two 0-5 years of age, two 5-10, one 20-30; females--one 5-10, one 20-30.
child8 vii. Gale or Gaylan LIVELY(1) was born about 1808. Probably the Gaylan Lively listed in the 1830 Census of Hines Co., Miss., with the following family: males--one 5-10, one 20-30; females--one 0-5, one 10-15, and one 20-30.
