Generation No. 6

13. BARBARA6 PETREE (JOHANN ADAM5, JOHAN JACOB4 PETRI, JOHAN NIKLAS3, JOHANNES2, JOHANN1)75 was born 06 Jan 1782 in Bethabara, Surry Co., NC76, and died Aft. 1860 in Adair Co., KY77. She married JOSEPH BOYER78 26 Mar 180178, son of HENRY BOYER and ANN SOELLE. He was born 21 Aug 1777 in Forsyth Co., NC79, and died Abt. 1858 in Adair Co., KY79.

Notes for J
OSEPH BOYER:
REPORT ON JOSEPH BOYER
By Lesly Klippel, 2/15/02

HERITAGE AND EARLY LIFE

Joseph Boyer was reportedly born August 26, 1777 in Rowan County, North Carolina, the eighth child of Henry Boyer and Catherine Ann Snell. Although I do not know the source of his birth day, it has been submitted to the International Genealogical Index (IGI) and can be found at <www.familysearch.org>. A search of the IGI failed to find the other children of Henry Boyer, but Sherryl Stoffers <sstoffer@inreach.com> has a list of them posted in Ancestry World Tree at <www.ancestry.com>. Her notes for Joseph Boyer agree word for word with notes posted by Frederick Rose in his database on that same site. In addition, Frederick Rose posted the following notes regarding Henry Boyer: "This family joined the Moravian Church Colony in North Carolina on the Yadkin River at Winston?Salem and became very prosperous. Henry was captured by Cornwallis but obtained his freedom when the British realized that the Moravians were pacifists at that time".

Joseph would have grown up among Germans of both the Moravian and Lutheran religion. Thousands of German families had traveled down the Shenandoah Valley from Pennsylvania just prior to and just following the Revolutionary War. The open fields of North Carolina were perfectly suited for the prevailing cash crop of tobacco and settlements were popping up throughout central North Carolina. As that area became overcrowded in the minds of land-hungry farmers, the families pushed west into Tennessee and Kentucky.

MARRIAGE

Several databases in Ancestry World Tree on Ancestry.com state that Joseph Boyer married Barbara Petry in 1794 but after Jo Martin reported to me that Bill Hurtzig of Sacramento, CA had found their marriage in the Surry County, NC records, I looked it up at the Family History Library (FHL) in Salt Lake City. The marriage took place on March 26, 1801 and is recorded in Holcomb, Brent H., Marriages of Surry County, North Carolina 1779?1868 (Genealogical Publishing Co., Inc., 1982), Family History Library, 35 North West Temple, Salt Lake City, UT 84150, US/CAN 975.665 V2h, page 19.

MOVE TO KENTUCKY

Joseph and Barbara had two sons born to them in North Carolina. They were William, born in 1802 and James, born in 1805. The family moved to Adair County, KY in 1807 where the notes in Frederick Rose's database in Ancestry World Tree claim they lived next to James Audubon while he made his bird sketches. A look at James Audubon's life in the encyclopedia shows that he opened a store in Louisville, Kentucky in 1807. Since Louisville is clear across the state from Adair county, it appears, without further study, that the story is in error.

Joseph Boyer first appears in Kentucky records in 1807 with a land grant of 100 acres on Dry Creek. A second grant of 50 acres on the Green River is also recorded in Kentucky Land Grants, a database at www.ancestry.com. Joseph first appears in the Adair county tax lists in 1810 as owning land on the Green River. (Family History Library microfilm 0007851 and 0007852, chronological) He subsequently appears in the tax lists through1844 which was the last year recorded on the second film. The later tax lists may shed further light on his life. They are on FHL films 0007853 and 0007854. These film were not available to me at my local Family History Center but could be viewed in Salt Lake City or rented through a Family History Center.

CENSUS RECORDS

Joseph Boyer does not appear in the 1810 Adair county U.S. census although the tax lists show he was living there at that time. He does appear in the 1820 census listed on page 8 as Joseph Booyier with 1 male between 10 and 16 years, 1 male between 16 and 26 years, 1 male between 26 and 45 years, 1 female between 10 and 16 years and 1 female between 26 and 45 years. This census shows a female living with Joseph that could be an unidentified daughter.

The 1830 census shows Joseph Bewier on page 13 with 1 male 50 to 60 years, 1 female 20 to 30 years and 1 female 30 to 40 years. So again, an unidentified female, probably a daughter, is living with Joseph and Barbara..

The 1840 census shows Joseph Booyer on page 21 with 1 male 60 to 70 years and 1 female 50 to 60 years.

The 1850 census, page 74 number 266, shows Joseph Booyer, 72 years, farmer, $300 real estate, born in North Carolina and Barbara Booyer, 68 years, born in North Carolina.

The 1860 census, page 77 number 527, lists Barbary Buoyar, 87 years, farmer, $200 read estate, born in Virginia; James P. Buoyar, 24 years, born in Kentucky and Ann F. Buoyar, 18 years, born in Kentucky.

JOSEPH BOYER'S SONS
William Boyer:
William Boyer was born in North Carolina in 1802. His birth year is supported by the fact that he first appears in the Adair county tax rolls in 1824 as a 21-year old male owning no land, but having one horse. The 1826 tax list shows the same but the 1827 tax list shows him as owning 100 acres and three horses. The tax lists for 1828 through 1832 show him listed with land on Green River. He does not appear in subsequent tax lists.

William Boyer married Sarah Smith in Adair county on February 10, 1823. She was listed as the daughter of William Smith and William was listed as the son of Joseph Boyer. (Burdetter, Ruth P., Compiler; Kentucky, Adair Co. Marriage Records, 1802?1840 (Transcription of original record), Family History Library, 35 North West Temple, Salt Lake City, UT 84150, US/CAN 976.9675 V25b; p. 12)

William Boyer is listed on page 28 of the 1830 census as Willm. Bowier with 1 male under 5 years, 1 male 5 to 10 years, 1 male 20 to 30 years, 1 female 5 to 10 years and 1 female 20 to 30 years.

I cannot find him in the 1840 or 1850 Adair county census although he may be there with a very corrupted name spelling. In 1852, William and Sarah sold 250 acres on Green River to Lewis Harmon (Adair Co. Deeds, Book O, page 390). It is not known to where they moved. Nothing further about this family is reported in the various databases on Ancestry World Tree or in the IGI.

James Boyer:
That son James Boyer was born in 1805 is supported by the fact that he first appears in the Adair county tax rolls in 1826 as a male over 21 years, owning no land and having one horse. In 1827, he was taxed on 100 acres on Green River and still had the horse. The tax lists for 1828 through 1835 list him on Green River. Apparently he did not die in 1834 as has been reported in some of the databases on Ancestry World Tree since he is listed as late as 1836.
James Boyer married Mary Neat in Adair county on December 2, 1824 (Researchers Publication, Kentucky; Adair County Marriages 1801?1850, Family History Library, 35 North West Temple, Salt Lake City, UT 84150, US/CAN 987.9 A1 #243; page 2). Some researchers have changed her name to Neal but the census records for the area clearly show a John Neat who is probably her father. The 1840 census shows Mary Bouyer on page 23 with five males under 15 years, 2 females 10 to 15 years and Mary, herself, as 40 to 50 years. She is living two doors away from David Neat, who appears, by the age categories of the family, to be her brother.

The widow, Mary Boyer, is listed on the Adair county tax rolls starting in 1842 with 114 acres on Green River. She is listed next to a James Boyer with 115-1/2 acres on Green River but I believe this is an error and that James should have been Joseph since Joseph Boyer should be on the list but is not listed. Mary would not have been listed on the tax rolls unless she were a widow and her son James could not have been listed since he did not turn 21 years old until 1847. Mary Boyer is listed on page 70 of the 1850 census, but the film at the Family History Center was too light to read and the images are not currently available on www.ancestry.com.

A couple of databases on Ancestry World Tree list James and Mary Boyer's children as Elizabeth Janes, Parenthia, Joseph W., David Hickman, James P., John A. J., and William Jefferson. I do not know the source of this list but it agrees with the family configuration in the 1840 census.

It looks like it was Barbara's grandson James P. Boyer and his young wife, Ann F., who were living with her in 1850. The Adair county marriage records may show his marriage in about 1849.

Apparently James' sons John, Joseph and James stayed in Adair county as there are many deed entries for them in the middle 1800s.

NAME SPELLINGS

I have found the name Boyer in various records with the following variations in spelling: Booyer, Booyier, Boier, Buoyar, Bouyer, Bowier, Bewier, Bawyer, Bayer and Bowyer.

OTHER SONS ATTRIBUTED TO JOSEPH BOYER

In a couple of the databases on Ancestry World Tree, two other sons are attributed to Joseph Boyer and Barbara Petry. One database has a son John, born in 1794. This could not be correct since we know that Joseph Boyer and Barbara Petry were not married until 1801. This John Boyer shows up in the Adair county tax list of 1815 next to Robert Boyer, both on the Green River. The list of children of Henry Boyer and Anna Catharina Snell on Ancestry World Tree is not in correct birth order but since Joseph is listed as being the eighth child, Robert could very well have been older and the father of a John Boyer who turned 21 years old in about 1815 when he first appears on the tax rolls. Robert was on the tax list for 1813 , so apparently he followed his brother Joseph to Adair county about that time. I believe that the John Boyer who married Mary Southerland in Adair county on May 8, 1823 is the son of Robert Boyer, Joseph's brother.

The Ancestry.com database, THE KENTUCKY LAND GRANTS, shows Grantee: Boyer, Robert, Acres: 150, Book: B, Page: 155, Date Survey: 1? 5?1816, County: Adair, Watercourse: Bryant Cr.

Another database on Ancestry World Tree attributes a son Jacob to Joseph and Barbara Boyer. There is no documentation attached and I have found no record of a Jacob Boyer living in Adair county in this time period. He does not appear on either the tax rolls or the censuses. I believe that Jacob as a son of Joseph and Barbara Boyer is incorrect.

I would hope that this report will clarify the Joseph Boyer family and be taken as documentation for his having only two sons: William and James. I do not mind this report being distributed as long as correct credit is given and no changes are made to the text. Copies of the quoted documentation are readily available to researchers through the Internet and local Family History Centers.

Notes for D
ANIEL PETREE:
Dear Jo,
I've written to you a couple of times before and here I am again! I am writing about Daniel Petree born 1785 died 1859. I am pretty well convinced that Daniel was not the son of Adam Petree and can find no evidence to convince me that he was. I wrote to Lesly
Klippel last year she sent me the following information that had been sent to her:

Norman Petree, a descendant of Daniel Petree places him as a son of Johann Adam with this explanation:
" Up to this time no records have been found to prove that Daniel is the son of Adam Petry. He may be a son of Dohert Petree who is listed along with Johan Jacob and Jacob Jr. on the 1790 census of Salisbury County. The census shows that Dohery had 5 white male. One of these may be Daniel, also I cannot find Doherty in the 1800 census so it is possible Doherty died before 1800 and Adam took in his nephew Daniel. However my reasoning for tieing Daniel Petry to Adam Petry as a son is twofold."

(1) Daniel served as a chain bearer in a land grant to Adam Petry. The children or nephews were usually used because of cost and it was in the best intrest of the land owner.
N. C. Sec. of State, Land Office , Washington Co. Tenn.
File Folder 1177
Acres 300
Grant 1135
Issued 7 July 1794.
Entry E. 2717,
Entered 4 Jan. 1781, Bk81, P.621

(2) Also in the first census of the United States-Heads of Families-North Carolina-1790 Salisbury District, Rowan County, Adam Petrey is listed with 1 white male 16 yrs and up (Adam); 6 white females, 2 white males under 16 (Daniel & Francis). Therefore I believe that Daniel was either a son or nephew of Adam Petree. Or prossibly an accepted illegitimate son, this could be the reason for him not being in his grandfather Johan Jacob's will. I realize that this is quite a stretch, but at this time I can come to no other conclusion.
Signed; Norman Petree

Last year I decided to resign myself to the fact that I would never know for sure who Daniel's father was and decided to just concentrate on Daniel's descendants and it worked for a long time! It's always in the back of my mind, though, so I though I would write you one more time to see if you have any evidence that I'm not aware of! It drives me crazy!!!

Thanks,
Suzie Petree Nuckols
