Henry Petree's will reads:

"In the name of God Amen! I, Henry Petree of the County of Stokes and State of NC do make and declare this my last will and testament, that is to say, I will that my Executor herein after named, sell at public auction the whole of my personal property upon a credit of six months and after paying all my just debts, I will and bequeath one half the proceeds thereon and one half of all the money which I may have at the time of my death, to my beloved wife,Sarah Petree and the other half of the proceeds of my personal property and money I give and bequeath to my children. To my son, Riley F. Petree, I give and bequeath the sum of twenty-five cents and no more. The remainder I equally divide between William H. Petree, Margaret F. Anderson, Elizabeth Doub, Catherine Spainhour, Ezekial B. Petree and Rebecca Helsabeck. "I also will and devise the whole of my lands with all improvements to my said wife Sarah Petree, for and during her natural life, and at her death, I will the said lands and improvements to my said children. To my son, Riley F. Petree, I give and bequeath twenty-five cents and no more. The remainder I equally divide between William H. Petree, Margaret F. Anderson, Elizabeth Doub, Catherine Spainhour, Ezekial B. Petree and Rebecca Helsabeck and their heirs forever. "And I do hereby constitute and appoint my nephew, William Wesley Petree and David R. Leak, Executors of this last will and testament in witness where I the said, Henry Petree, do hereunto set my hand and seal this 31st day of Jul A.D. 1866.

In settling this estate, when the lands were finally sold most of the property was bought by F. E. Petree. Whether he disinherited Riley Frost Petree, who incidentally signed a receipt indicating he was paid $1.00 rather than the twenty-five cents in the final settlement, or intended the note to be excused, there is some tradition that they disagreed on taking sides for the Confederacy and the Union during the Civil War.


Grave markers for Henry and his second wife, Sarah, are located in the Tuttle Cemetery, located in Meadows Township, Stokes Co., NC, about one mile off Bolejack Rd., #1961, near Friendship Rd. #1955 and on the property of William Kiser. The stones are very worn, very hard to decipher the dates. William Kiser states that the grave markers are very unusual in that they are both placed horizontally, raised up about a foot from the ground by some rocks, and in the shape of a coffin. The lettering is on top and is very weathered. The following saying is on one of their markers, Mr. Kiser is not sure which one: "The sun and moon must turn to blood, here on this solemn spot of ground, I lay my lifeless body down, to mingle with its mother clay until that great judgement day and remember this as you pass by, as you are now, so once was I, and as I am now so you shall be, prepare for death and follow me."

VA REBECCA BUCHANAN:


In 1832 after Rebecca Buchanan and Henry Petree had been married for twenty years, she petitioned the court for divorce from "bed and board." Neighbors and relatives testified in court that Henry had poured whiskey on her and pushed her from the house. Evidently Henry was an alcoholic and very abusive man. Rebecca stated in court that she had left him several times before but had always returned because of the children. The court granted the divorce and ordered Henry to pay her twenty-five dollars per year for support of the children. Evidently he refused to do this because in 1834 she was back in court, asking that the decree be enforced. Henry's brother, Solomon, testified that Henry had at least two hundred dollars, a mare, a wagon, beds, other items but that he had left the area with his oldest son, rather than meet his obligations. Rebecca's sister, Elizabeth and her husband Ezekial Frost, helped her and her children. In fact, when Elizabeth died, she left three hundred dollars to Rebecca to be loaned out at interest to be paid to Rebecca in her lifetime. Divorce decrees in those days meant that neither party could remarry until one died. Rebecca died 24 Jul 1843 and is buried in a graveyard near King, NC. She will be remembered as a lady of great courage, brave enough to refuse to live with an abusive man and intelligent enough to not want her children exposed to such behavior. After her death, Henry returned to the area and remarried.

Following letter received in 1993 from Rachel Rawls, MD concerning Petree:

Dear Jo,

The divorce papers for Rebecca Petree are enclosed. It was an interesting case. I think I mentioned earlier that when Elizabeth Buchanan Frost died, she left Rebecca the income from $300 which stated: "shall be loaned out on interest and the interest owing thereof be paid or given to my sister, Rebecca Petree yearly during her natural life, and after her decease the said three hundred dollars to be equally divided between John H. Bitting, my son-in-law and Elizabeth B. Frost and James Frost my grandchildren" This will was witnessed by Riley F. Petree, _________Gibson and J. Gibson. The Will was probated March 1841, apparently.

I remember, as I wrote you, my grandfather telling me that his father, an uncle, and I think his older brother, fought with the Union Army. You have to take this with reservations because it has been more than 50 years since I heard it, and my grandfather was born after the Civil War so it had to be at least second hand with him. It was the Uncle and I don't know which .... that was captured by the Confederates, and nearly hanged using a grapevine, however the vine broke. He was then imprisoned. When he was released at the end of the War he only weight 90 pounds. Riley Frost Petree was a member of the NC constitutional Convention after the Civil War - this is documented and mentioned in NORTH CAROLINA GOVERNMENT 1585-1979, issued by Thad Eure, Secretary of State, 1981. Riley Frost Petree was a delegate from District 19, Stokes Co., NC. Joseph Abbott was from New Hanover County, NC and David Heaton from Craven Co.,NC. Both of them are mentioned in histories of the post war period as being "Carpetbaggers." I have relatives living in the area who probably would prefer not knowing some of these facts, and I want to get other information about the family from them later! Personally, I am rather proud of people who have convictions an stick by them. Actually a good many people in the part of the state where they lived were anti-slavery for a number of reasons, and a number opposed secession as well. The anti-slavery sentiment stemmed partly from religious and moral convictions ... and many of those of German descent just did not like slavery in any way and political considerations. Slaves and of course women, were counted as part of the population when representation to both the state and federal houses of the Legislature were allotted. The Eastern "Establishment" could count on many more slaves than in the Piedmont and West. The East seemed to have more influence on legislating because of that fact. Although NC furnished a huge proportion of the Confederate troops, there continued to be a lot of dissatisfaction ... exemptions were given for certain occupations and office holders for one thing. More prosperous men could pay substitutes and escape being conscripted, etc. Incidentally, I can remember even in my youth some comments about this. I remember a family having something in the paper (on the occasion of a wedding or something) about being descended from Colonel________, I really cannot remember the family name I am glad to say, and hearing my aunts remark that he had actually paid a substitute until it got embarrassing and then he organized a Unit and was elected a Colonel. I believe that some of the time the Confederate troops did elect their own officers, and a man who furnished uniforms, etc. would normally be elected an officer. I think they discontinued that practice as the war wore on. I asked a descendant of my grandfather's oldest brother, with whom I had corresponded, if he had heard about his great grandfather fighting for the Union. ........."

At this point I will not continue with the remainder of her letter to me as it contains names of descendants of Johan and Eva Kuhnelin Petree. She ends the letter with comment: " My letters 'run on' too much."

HOMAS JEFFERSON TUTTLE:
Willliam Kiser states that the marker for Thomas J. Tuttle's grave is interesting in that when they spelled Thomas Tuttle across the top, they ran out of room, and had to start the second line midway through Tuttle. His grave marker was ordered by mail. He found Thomas' grave on his property in an old graveyard known by locals as "Tuttle Cemetery." Headstones in this grave include names of Tuttles, Hamptons, Petrees, Boles, Plummers and probably many others. The grave site is located at the top of a hill that overlooks Mr. Kiser's farm and is near the "old road" used before any modern conveyances were in place. He estimates that there are approximately 50 graves in this cemetery. There are lots of stones marking graves, quite a few "hand-lettered" gravestones, and a few "store bought."
