JOSEPH BARSALOU (son of SALVY BARSALOU) was born 1600 in FOULAYRONNE FROUMENTY, FRANCE, and died 28 Feb 1659/60 in FRANCE. He married CATHERINE COMINAL on 23 Oct 1634 in ARTIGUES ST SERNIN, FRANCE, daughter of COMINAL ANCETRE.

Last will and testament of Joseph Barsalou, 9 Jan 1658, before the Royal Notary Me Castaigner-Agen (Guyenne).

Before noon 9 Jan 1658, in the office of Me Castaigners Royal Notary from Agen, France, Joseph Barsalou dictated his will - it is said he is sound of mind and body, memory, understanding, well informed. Stating that he wants to be buried in the tomb of those preceding him, entrusting the funeral arrangements (honours) to the discretion of his wife Catherine Cominal. Joseph Barsalou declares having sired 3 children with his first wife, Francoise Valade.

1. Louise, wife of Guillaume Bruguiere, to whom he establishes a dowry of:
400 pounds in personal property (estate) mentioned in her marriage contract (authorized on the paternal side).
400 pounds (authorized on the maternal side (all paid).

100 pounds that the testator of her, over and above to supplement the maternal rights. This sum is to be taken from the amount of 245 pounds loaned to Guillaume Bruguiere, the testator's son-in-law, in addition to the amount of 30 pounds, the balance of the price of a cow sold to said Bruguiere by the testator. If the latter mentioned was to reimburse this sum before the death of his father-in-law, Joseph Barsalou wishes that the legacy of 100 pounds be paid by his legatees. In consideration of this, he understands that Louise cannot demand another thing from his estate and that of her mother.

2. Jeanne, wife of Bernard Boutote to whom he bequeaths a dowry of 300 pounds in personal property, mentioned in her marriage contract (authorized on paternal side).

500 pounds (authorized on the maternal side) not entirely paid. The testator entrusts his heirs (legatees) to settle the balance of this declaration, and in consideration of this, 5 supplementary sols (an amount-of-money of fixed value). Joseph Barsalou expects that Jeanne cannot demand more of his estate and that of her mother.

3. Pierre, husband of Peyronne Amouroux, to whom he bequeaths by contract of marriage, the property he owns in Foulayronnes parish, Ste Foy, Agen containing 6 cartherees (acrege), one half of a house located in the village of Cassaigne, with a barn which he has reserved (set aside) in usufract- (the legal rights to enjoy, profit, and to benefit from a thing that belongs to another- without altering or damaging the item.) The testator states having paid to Louise and Jeanne, the portion of his possessions that they have rights to as co-heirs of Francoise Valade, their mother, who died without a will, by the instructions expressed at the time of their marriage. These rights are bequeathed to Pierre, substituting the maternal rights. In addition, the testator bequeaths hin in the village of La Cassaigne, a vineyard of 13 carthonats (acreage) (al piez de Tuque) at the foot of the Tuque - plus a plot of woodland, located at la Cassaigne near the house of Valade - plus a piece of meadowland, located in the valley of la Cassaigne.

The said house, Vineyard, meadow and woodland and formerly acquired from the deceased Andrieu Valade in accordance with the contract of purchase (sale contract) he validated, further, he bequeaths that sum paid to Louise and Jeanne, sisters, for their maternal rights enabling him to prevail against the two sisters, so that they cannot demand any other rights or property (estate) of said Valade. And to retain (refuse) payment of the said right by the information and payment recorded in the arbitration award of 5 Nov 1632, concerning the liquidation of the inheritance of the said Valade, this awary held by me Dufour Royal Notary from Agen. In consideration of the bequest, 5 supplementary sols (money of fixed value- payable in the year of his (the testator) death to the said Pierre. Joseph Barsalou understands that the latter can demand nothing else concerning his inheritance and that of his mother and the property she owned in the parish of Ste Radegonde, sold by the testator.

If Jeanne and Louise are unwilling to be satisfied with the amounts which were given them by their maternal rights, the testator wishes his son Pierre to satisfy them, if they feel that something is due them, without demanding any guarantee against the undersigned residuary legatees, if this be the case, the above-mentioned legacy is revoked and Pierre is given but 5 sols.

Joseph Barsalou declares that he remarried to Catherine Cominal and born from the said marriage were:
Bernard-Guillaume-Pierre-Jean-Francois-Antoine.
For her entire life, he bequeaths to Catherine Cominal, the use and enjoyment of all his possessions (viduellement) vidue=ancient French=widow.) during her widowhood, caring and feeding the children from their marriage but if she is unable to live with them, they shall be required to provide her with board and lodging her entire lifetime. For her home a small house located on "Les Cerises" street in Agen.
6 sacs of the very best wheat
3 barrels of pure wine
1 barrel of half wine (demin vin)
20 fagotts (bundles) of vine shoots (firewood) for heating.

Due every year in the month of March. The said Cominal will not be able to claim anything else nor any augmentation of her rights.

2. Guillaume his son:
A house on "LaPorte du Pin" street in Agen, acquired from the deceased Bertrand de Saint-Gillis (man at arms)
600 pounds in cash
Payable=200 pounds to be paid upon the death of the testator, also, interest. Failure to pay promptly, the interest will be paid by his heirs legitimately (a bob droit) to the last (vingt) penny. Considering this, the said Guillaume will not be able to claim any part of his father's estate-property.

3. Antoine, his son:
600 Pounds in cash.
Payable=200 pounds when he reaches the age of 25, then 200 pounds annually, up to that time, the testator wishes his son to be nourished and maintained with, his inheritance and placed in an apprenticeship in whatever trade pleases him, at the expense of the undersigned heirs. In the meantime they are responsible to pay him the sum of 600 pounds, which shall include his food and the expenses of apprenticeship.

4. Bernard + Pierre + Jean + Francois, his sons and the said Cominal are named as general and residuary heirs for the remainder of the estate - property, with vote, name, reasons and actions of the testator in equal portions and are charged with paying his funeral expenses, debts and legacies.

Joseph Barsalou wishes that after his death, there shall be an inventory taken of his estate by the notary Me Castaigner, if one of his residuary heirs dies without children, the others can substitute by equal parts, his portion, to the last one and if all four die without children, he substitutes Guillaume and Antoine in equal portions. If Guillaume and Antoine also die without children, he substitutes Bernard, Pierre, Jean and Francois to share in equal parts.
