+ "Henry Cable/Kable was tried at Thetford, Norfolk on March 14, 1783 for burglary with a value of 450 shillings. he was sentenced to transportation for 7 years having been originally sentenced to death, and left England on the convict transport 'Friendship' aged about 20 (May 1787). His occupation was listed as labourer. He died March 16, 1846. He married Susannah Holmes whom he met on the prison hulk 'Dunkirk'. He was an early entrepeneur and a night watch member." + Henry and Susannah Kable were involved in the civil case in NSW. In the book "Tradition and Change in Australian Law" by Patrick Parkinson [The Law Book Company, 1994, pp. 131,132-133.] we read:
"In the early years of the colony, the priorities were first and foremost survival in the harsh conditions of the county, and the establishment of New South Wales as a working convict settlement. In this early period, the colony was essentially under the personal rule of the Governor with the assistance of the army...
Despite this, thought had been given in the establishment of New South Wales to the development of a colony with some of the central features of civil rule, and provision of a civil and criminal law system. It was to be a colony established by proper legal authority, and one in which some semblance of law prevailed.The first Charter of Justice for New South Wales, established by Letters Patent of 2 April 1787, provided for a court of civil jurisdiction consisting of the Judge-Advocate and two other "fit and proper persons"...
The civil court also sat within a few months of the establishment of the colony. Indeed, the first civil case shows the extent to which even convicts were treated as having legal rights and could seek to vindicate those rights before the courts. This case was brought in July 1788 by two convicts, Henry and Susannah Kable, against Captain Sinclair, the captain of one of the ships of the First Fleet. They claimed the loss of a parcel of clothes and other items worth 15 poinds. It was proved that the parcel was loaded on board the ship Alexander before they set sail in 1787, but the parcel was missing when they landed in New South Wales. Damages of 15 pounds were awarded to them agaist the ships captain. The case is remarkable since the doctrine of attainer in English law provided that as convict felons, they had lost all civil rights and were not entitled to the protection of the courts. By overlooking this problem, the court established early in the life of the new colony that convicts would be able to use the civil law in their favour. Inasmuch as the case was brought by convicts agaist powerful man as a ship's captain, it also showed that the principle of equality before the law was taken seriously even in a new penal settlement 12,000 miles from Britain." She died November 8, 1825. She married Henry Kable on February 10, 1788. They had met in gaol and had a child (Henry) there in 1786.
