13. Josiah SWINDLE Sr. was born in 1732 in Albemarie, Hyde Co., North Carolina. He died on May 7 1804 in Hyde Co., North Carolina. He signed a will on May 7 1804 in Hyde Co., North Carolina. Josiah Swindell Sr., son of John Swindell Sr., left a Hyde County will dated 7 May 1804, probate August Court 1806. His son Abraham Swindell, and his heirs, were "cut off" with "one single Shilling Starling and no more." Josiah's wife, Esther, was the widow of Ignatus Harbert who died in 1798. - she could not have been the mother of his children Abraham, Caled (Jr.), Ananias, Samuel, Willis, Robert, Marget Sadler, Priscilla Harris, Delilah Davis, Ann Meekins, Nd Elizabeth Farrow. He was married to Ballance in Hyde Co., NC. He had an estate probated in Aug 1806. child 1 John Swindell i-1211
Ellen Mitchell, researcher in Hyde CO. N.C. indicated that there was no will for John Swindell 1, but there was an Estate Record in Hyde CO. VOl-1 part 1, about 1722. She also indicated that his son Zedekiah's birth record was recorded in Pasquotank Co., N.C. (Pasquotank was a precinct of Albemarle Co, then.)
Records indicate that John purchased many different farms from 1729-1765 and sold some as well. These usually were from 100 acres to 1000 acres. He must have accumulated about 5,000 acres of land. Much of this land, was of little cost, and some for 'quitrents'

1798 - Sept. 1, Josiah Swindell Sr. to Robert Swindell 94 acres sw Mattmuskeet Lake at a ThornbeenTree at corner. Robert was his son...
1806 Aug. Court Will of Josiah Swindell, Hyde County, N.C. written 7 May 1804...... etc. Leaves mechanic tools equally divided among sons and names them, ; furniture to daughters and names them, ; most estate to wife, Esther then equally divided at her death to his 10 children....witnessed by John Henry, Thomas Sanderson... Hyde Will book # 3 page 208 .

He was married to Esther BALANCE in 1756. Esther BALANCE was born about 1732 in Hyde Co., North Carolina. She died about 1810 in North Carolina. Josiah SWINDLE Sr. and Esther BALANCE had the following children:

Abraham Swindell, son of Josiah Swindell, Sr., was born circa 1755 and was another of Josiah's sons to serve in the Revolutionary War. In a 1778 list of Hyde militia who volunteered to serve as Continental soldiers for the term of nine months, Abraham is listed as age 23, born and living in Hyde County, 5 feet and 7 inches in height with fair hair and blue eyes. We found no further information on Abraham Swindell in any of the Hyde County records & his fate is a mystery!!
